Terms of Service & Privacy Policy

Terms of Service
1. Acceptance of Terms
By creating an account, accessing, or using FaunaCommand™ ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you use the Service on behalf of a business or organization, you confirm you have authority to bind that organization.
2. Eligibility & Accounts
You must be at least 18 years old to create an account. You are responsible for the accuracy of the information you provide.
Account owners control the permissions granted to team members (Admins and Staff) they invite. Removing a team member revokes their access to your facility data.
3. Subscriptions, Trials & Billing
The Service offers a free tier and paid subscription tiers, plus optional add-ons. Current pricing and limits are shown on the Features page and may change; changes to recurring prices apply going forward and do not alter a billing period already paid.
New accounts may receive a free trial. When a trial or paid subscription ends or is cancelled, your account returns to the free tier and features or limits above that tier may become locked. Your data is not deleted because of a downgrade.
Payments are processed by Stripe. Subscriptions renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable.
4. Your Content & Data
You own the records, documents, photos, contacts, and other content you add ("Your Content"). You grant us a limited license to store, process, and display Your Content only as needed to operate and improve the Service for you.
You are responsible for having the right to upload Your Content, including any personal information about your customers, adopters, buyers, sellers, or visitors, and for complying with laws that apply to how you collect and use it.
5. Public Pages & Sharing
Some features let you publish information publicly, such as adoption galleries, booking pages, signing links, and facility contact details. Anything you choose to make public can be viewed by anyone with the link. You control what is shared and can turn these features off.
6. Payments You Collect
If you connect your own Stripe account to collect deposits, adoption fees, or booking payments, those transactions are between you and your customer. You are responsible for your pricing, taxes, refunds, disputes, and compliance with Stripe’s terms.
7. Contracts, Waivers & E-Signatures
Electronic signatures collected through the Service record the signer’s name, consent, and a timestamp. You are responsible for confirming that e-signatures are appropriate for your use and jurisdiction, including signatures by a parent or guardian on behalf of a minor.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose, including illegal animal trade or animal cruelty.
- Upload malicious code or attempt to access accounts, data, or systems you are not authorized to access.
- Reverse engineer, resell, or copy the Service, or overload it with automated requests.
- Send spam or unsolicited messages through the Service’s email or sharing features.
- Upload content that infringes others’ rights or is harassing, hateful, or obscene.
9. Animal Care Disclaimer
The Service is a record-keeping and management tool. Health reminders, medication schedules, pedigree and genetics data, and care logs are aids only and are not veterinary advice. Always consult a licensed veterinarian about animal health. You remain solely responsible for the care and welfare of your animals.
10. Third-Party Services
Optional integrations such as Stripe, Google Calendar, and email delivery are provided by third parties under their own terms. We are not responsible for the availability or actions of third-party services.
11. Feedback
If you submit suggestions or feedback, you grant FaunaCommand™ the right to use and implement them without compensation or credit.
12. Intellectual Property
The Service, including its software, design, logos, and the FaunaCommand™ name, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
13. Suspension & Termination
You may delete your account at any time from Settings. Deleting an owner account permanently deletes that facility’s data; staff deleting their account only removes their own access. We may suspend or terminate accounts that violate these Terms or create risk for other users or the Service.
Limitation of Liability & Communications
1. Limitation of Liability & User Responsibility
By using FaunaCommand™, you explicitly acknowledge and agree that:
- The developer and host are not liable for any data breaches, unauthorized access, or loss of information.
- You are solely responsible for securing your account credentials and for all actions taken by team members (Staff/Admins) you invite to your facility.
- All features, including health records, pedigrees, and document vaults, are provided "as is" without warranties of any kind.
- Contract templates and legal documents generated within the application are provided for convenience only; they do not constitute legal advice and should be reviewed by your own legal counsel before use.
- FaunaCommand™ is not responsible for any loss of business or data resulting from technical bugs, server downtime, or the suspension of services.
- By maintaining an active subscription, you agree that your data is stored at your own risk.
2. Communications
By creating an account, you consent to receive the following communications from FaunaCommand™:
- Transactional & Operational Alerts — account verification, password resets, subscription confirmations, payment receipts, team invitations, appointment confirmations, and other essential service messages. These cannot be opted out of.
- Program & Feature Updates — app update announcements, new feature releases, and product improvement notifications. You may opt out in your account settings.
- Promotional & Educational Content — tips, guides, best practices, special offers, and educational content related to animal management. You may opt out in your account settings.
Privacy Policy
1. Information We Collect
- Account information: name, email address, facility name, and login details.
- Facility content: animal records, health and care logs, breeding data, documents, photos, contacts, appointments, and financial entries you enter.
- Billing information: subscription status and payment records. Card details are handled by Stripe and are never stored on our servers.
- Usage information: basic technical data such as device and browser type, pages visited, and activity logs used to secure and improve the Service.
- Integration data: if you connect Google Calendar, we store only what is needed to sync events.
2. How We Use Information
- To provide, maintain, and secure the Service and your team’s shared workspace.
- To process subscriptions and send receipts, confirmations, and other service messages.
- To send the communications described in the Communications section.
- To provide support, troubleshoot problems, and improve features.
- To comply with legal obligations and prevent fraud or abuse.
4. Your Customers’ Information
When you store information about adopters, buyers, sellers, visitors, or guardians, you are responsible for that information and for providing any notices your customers are owed. We process it on your behalf only to deliver the Service, such as sending the confirmations, waivers, and payment links you request.
5. Data Security & Retention
Data is encrypted in transit, access is restricted by account and team permissions, and public pages hide sensitive details. No system is perfectly secure, so we cannot guarantee absolute security.
We keep your data while your account is active. When an owner deletes their account, facility data is deleted, except for limited records we must keep for legal, tax, or security reasons.
7. Your Choices & Rights
You can view and update your account information in Settings, export your records, opt out of non-essential emails, and delete your account. Depending on where you live, you may have additional rights to access, correct, or delete your personal information.
8. Children’s Privacy
The Service is not intended for children and accounts require users to be 18 or older. Minor participant information, such as a name on a guardian-signed waiver, is entered by facilities and handled as Your Content.
Changes & Contact
We may update these Terms and this Privacy Policy as the Service evolves. We will post the updated version here and, for material changes, notify you by email or in the app. Continued use after changes take effect means you accept them.
